Modified Comparative Negligence

Texas is a “modified comparative negligence” state, which means the judge or jury will examine all parties’ levels of fault for the accident in order to determine your right to damages. As long as you were less at fault for the accident than the other driver (less than 50% at fault), you may sue to recover damages. Note that the amount of damages you can recover will be the total accident award reduced by the percentage you were shown to be at fault.
