Understanding the Different Types of Car Accidents

Car accidents can happen in various ways and understanding the different types can help you better understand your situation and potential legal options.

Here are some common types of car accidents:

  • Rear-end collisions: These occur when one vehicle crashes into the back of another vehicle. They are often caused by tailgating, distracted driving, or sudden stops.
  • T-bone accidents: Also known as side-impact collisions, these occur when the front of one vehicle crashes into the side of another vehicle. They often happen at intersections and can result in serious injuries.
  • Head-on collisions: These occur when the front ends of two vehicles collide. They are often caused by wrong-way driving, distracted driving, or overtaking in a no-passing zone.
  • Multi-vehicle accidents: Also known as pile-ups or chain-reaction accidents, these involve three or more vehicles. They can happen on highways or in congested areas and often result in extensive damage and injuries.
  • Hit and run accidents: These occur when a driver involved in an accident leaves the scene without stopping to identify themselves or provide assistance. Hit and run accidents can make it challenging to pursue compensation.

Modified Comparative Negligence

Car accidents happen; they can be minor mishaps in some cases, or you might sustain serious injuries that require medical attention. In both cases, you have the right to file a civil claim for damages due to a car accident.

To obtain monetary compensation arising from a car accident, it is important to know how Texas awards damages. Texas is a “modified comparative negligence” state, which means the judge or jury will examine all parties’ levels of fault for the accident in order to determine your right to damages. That is, if you want to recover damages, you will need to prove that the other driver(s) were at fault for the accident causing your injury. As long as you were less at fault for the accident than the other driver (less than 50% at fault), you may sue to recover damages. Note that the amount of damages you can recover will be the total accident award reduced by the percentage you were shown to be at fault.

Types of Damages and Limitations

There are several types of damages you can recover based on the circumstances of your accident. For one, you can request economic damages, which are direct expenses incurred as a result of the accident, such as repairs to your car, lost wages or earning capacity, and medical expenses. You can also obtain non-economic damages, which address the pain and suffering, disability, or loss of companionship that you or your loved one may be suffering due to the accident.

In more severe cases involving gross negligence, you may also be awarded exemplary, or punitive, damages meant to penalize the offending party.

While you can recover damages for your accident, note that Texas has certain damage caps in place, such as:

  • Maximum of $100,000 if the accident occurred while a public servant was performing their job duties
  • Exemplary (punitive) damages limited to the greater of $200,000, twice the amount of economic damages plus $750,000, or twice the amount of economic damages plus the amount of non-economic damages

Get Started on Your Accident Claim

Be aware that the statute of limitations, or the time you have until you can no longer file a car accident claim, is 2 years. Once 2 years have elapsed from the date of the accident, the court will be unlikely to hear your car accident lawsuit, and you will not be able to retain damages. As a result, it is important that you get started on your car accident matter as soon as you can before the statute of limitations flies by.
